Welcome to Ascend! These Terms of Service (“Terms”) are an agreement between you and Ascend Viral LLC (“Ascend”, “we”), and they govern your access to and use of Ascend’s website (ascendviral.com) and app (app.ascend.so), including any content, features or plans offered as part of the service (the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Service.
Overview of Services
Ascend is an AI platform for Instagram growth. It studies public Instagram videos and accounts, shows you what is working in your niche, and answers your questions in an AI chat. On the plans that include it, the Growth plan adds a real person from our team who engages with targeted, real accounts in your niche on your behalf. We do not use bots or fake engagement, and we do not sell followers, likes or comments.
Your Account and Responsibilities
When you create an Ascend account, you agree to provide accurate and up-to-date information and to keep the email address you sign in with secure. Anything done through your account is treated as done by you.
You are responsible for your own Instagram account and for making sure it complies with Instagram’s terms of service. Ascend is not liable for any violations, restrictions or actions taken by Instagram against your account, including bans or suspensions.
Plans, Free Trial and Billing
Ascend offers a Free plan and paid monthly plans. Paid plans start with a 5-day free trial: when the trial ends, the plan converts to a paid subscription and the first charge is made, unless you cancel before the trial ends. Subscriptions renew automatically every month until cancelled.
You can cancel at any time in Settings in the app. Your plan stays active until the end of the billing period you paid for, then your account moves to the Free plan. Simply messaging us does not constitute a cancellation.
When you change plans, the change applies right away and the price is adjusted for the time left in your billing month. Current prices are listed on our pricing page; we may change prices, with notice before your next renewal. See our Payment Policy for accepted payment methods, billing currency and renewal timing.
Credits and Prepaid Balances
Credits, including prepaid credits purchased as credit packs and any bonus or promotional credits, give you a limited, non-transferable right to use features of the Service. Credits have no cash value, are not money, a deposit or a stored-value account, and cannot be redeemed, exchanged or withdrawn for cash or anything else of value. All credit purchases are final and non-refundable, except where the law requires otherwise.
Prepaid credits and bonus credits (such as an early-start bonus) can be used only while your account has an active paid subscription. They cannot be used on a free account, during a free trial, or after your subscription ends, and they remain on your account until a paid subscription starts again. Credits cannot be sold, transferred or moved to another person or account. Ascend Viral may change which features use credits and how many credits a feature uses.
Refunds
Our refund policy is published on the Refunds & Returns page, and it is the policy that applies to every charge. In short: if you’re not happy, tell us within 10 days of your first payment and we’ll refund it, once per client. If you’re charged by accident, tell us within 48 hours of that charge and we’ll refund it. Billing mistakes on our side are always refunded. A refund ends the plan. Cancelling in Settings stops future charges. Credit packs and other credit purchases are not refundable; see Credits and Prepaid Balances.
Service Expectations
Growth results vary based on factors such as niche, content quality, account history and target audience. Ascend does not guarantee specific numbers of followers, likes or engagement levels — the people you reach are real and decide for themselves. Our goal is to help you build an engaged, authentic audience around your content through ethical and sustainable methods.
We do not use bots or artificial engagement, and we do not promise or sell followers, likes, or comments.
Limitations of Liability
Ascend is not responsible for any actions Instagram may take against your account, including but not limited to temporary restrictions, shadowbans, or permanent account suspension. By using our services, you release Ascend Viral LLC from legal responsibility related to any actions taken by Instagram on your account.
Ascend is not liable for any losses, including but not limited to loss of followers, account restrictions, or impacts on business, that result from factors outside our control, such as Instagram’s algorithm changes or external growth services used by the client.

Privacy
How we collect, use and protect personal information is described in our Privacy Policy. We will never sell your personal information.
Communication
The fastest way to reach us is email: support@ascendviral.com. You can also call +1 (385) 266-8404. On the Growth and Viral plans you can message your growth assistant from Messages in the app, and on every plan you can send feedback from Settings. We typically reply within one business day.
Service Refusal and Termination
Ascend may refuse or terminate service where reasonably necessary, including for:
- Providing inaccurate account or billing information.
- Using a payment account that is flagged by our payment processor.
- Providing Instagram accounts that violate Instagram’s terms of service.
- Inappropriate behavior towards our team or other users.
- Misusing free trials, credits or promotions.
- Any other violation of these Terms.
Use of Cookies
Ascend uses cookies to enhance your browsing experience and improve the functionality of our website. Cookies are small data files stored on your device that help us analyze website traffic, personalize content, and provide a more user-friendly experience. By using our website, you agree to the use of cookies in accordance with our privacy policy. You can disable cookies through your browser settings if you choose, but this may affect the performance of our website.
Payment Processing
Ascend uses Stripe, a trusted third-party payment processor, to securely handle all transactions. By purchasing a plan or credits, you agree to Stripe’s terms of service. Ascend does not store your payment information directly and is not responsible for any issues arising from the payment processor.
Affiliations
Ascend is an independent product of Ascend Viral LLC and is not affiliated with Meta, Instagram, Facebook, TikTok, Google, or any other platforms or services. Our growth methods comply with Instagram’s terms of service but operate independently of any formal affiliation with Meta or its associated companies.
Acceptable Use
Clients agree to use Ascend’s services in accordance with applicable laws and regulations. You agree not to use our services for any illegal or unauthorized purposes, including but not limited to:
- Violating Instagram’s terms of service.
- Engaging in fraudulent or misleading activities.
- Using the service to harass, abuse, or harm others.
Violation of these terms may result in immediate termination of your account without refund, as well as potential legal action.
Governing Law
These Terms of Service are governed by the laws of the State of Wyoming and the United States, and any legal disputes arising from the use of Ascend’s services will be subject to the jurisdiction of the courts in Sheridan, Wyoming.
Intellectual Property and Copyright
All content and materials available on this website, including but not limited to text, graphics, images, logos, videos, audio clips, software, code, data compilations, design, layout, look, and appearance (collectively, the “Content”) are the property of Ascend Viral LLC or its content suppliers, and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws, unless otherwise stated.
The compilation, organization, and display of the Content, as well as all software and inventions used on or associated with this website, are the exclusive property of Ascend Viral LLC.
Restrictions on Use
You are granted a limited, non-exclusive, non-transferable license to access and view the Content solely for your personal or commercial use. Except as otherwise expressly authorized by Ascend Viral LLC, you agree not to:
- Reproduce, distribute, modify, transmit, display, perform, publish, license, create derivative works from, or sell any Content, products, or services obtained from this website.
- Download, copy, or use any portion of the Content for commercial purposes without the prior written consent of Ascend Viral LLC.
- Reverse-engineer, decompile, disassemble, or extract any software or proprietary code from the website.

All trademarks, service marks, logos, and trade names displayed on this website are the property of Ascend Viral LLC or other third parties. You may not use, reproduce, or display any of the trademarks without prior written consent from the trademark owner.
Reservation of Rights
Ascend Viral LLC reserves all rights not expressly granted in these Terms of Service. Any unauthorized use of the Content or website may result in the termination of the limited license granted to you, without further notice.
Changes to the Terms of Service
Ascend reserves the right to update or modify these Terms at any time. Clients will be notified of significant changes, and continued use of the service following any updates constitutes acceptance of the new Terms.
